I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, hereby make the following regulations under the Animal Welfare Act 1993 .

1.   Short title

These regulations may be cited as the Animal Welfare Regulations 1993 .

2.   Commencement

These regulations take effect on 1 January 1994.

3.   Interpretation

In these regulations –
Act means the Animal Welfare Act 1993 ;
domestic fowl means an animal of the species Gallus gallus.

4.   Control of prescribed animals

For the purposes of section 8(2)(h)(v) of the Act, the animals listed in the first column of the table set out in Schedule 1 are prescribed animals and the substances listed opposite each animal in the second column are prescribed substances for the control of that animal.

4A.   Prescribed act

[Regulation 4A Inserted by S.R. 1997, No. 163, Applied:24 Dec 1997] For the purpose of section 8(2)(k) of the Act, the strangling of an animal with a device or by any other means is a prescribed act.

5.   Use of electrical current

[Regulation 5 Inserted by S.R. 1996, No. 15, Applied:01 Apr 1996] An animal may be restrained by the use of a pulsed, low frequency electrical current only if it is administered by a veterinary surgeon registered under the Veterinary Surgeons Act 1987 .

6.   Domestic fowls in cages

(1)  A person who keeps domestic fowls of 18 or more weeks in cages must keep them in cages which have a floor area of at least –
(a) 1000 cm2 if one fowl is in the cage; or
(b) 675 cm2 for each fowl, if 2 fowls are in the cage; or
(c) 450 cm2 for each fowl, if –
(i) 3 or more fowls are in the cage; and
(ii) the average flock weight of the fowls is not more than 2.4 kg; or
(d) 600 cm2 for each fowl, if –
(i) 3 or more fowls are in the cage; and
(ii) the average flock weight of the fowls is more than 2.4 kg.
Penalty:  Fine not exceeding 20 penalty units.
(2)  An officer is to determine the average flock weight in accordance with the "National Guidelines for RSPCA Inspectors for the Inspection of Layer Hens in Cages" which is included in the Australian Model Code of Practice for the Welfare of Animals – Domestic Poultry, issued by the Agriculture and Resource Management Council of Australia and New Zealand.

7.   Licence application fees

[Regulation 7 Inserted by S.R. 1996, No. 15, Applied:01 Apr 1996] The fees specified in Schedule 2 are payable in respect of an application for a licence to carry out animal research.
