Inland Fisheries (Seasons and Waters) Order 1996

I make the following order under section 197 of the Inland Fisheries Act 1995 .

1.   Short title

This order may be cited as the Inland Fisheries (Seasons and Waters) Order 1996 .

2.   Commencement

This order takes effect on 31 May 1996.

3.   Interpretation

(1)  In this order –
Act means the Inland Fisheries Act 1995 ;
eligible person means a person with eligible disabilities for the purpose of a transport access scheme administered by the department responsible for the administration of the Traffic Act 1925 ;
juvenile angling pond means a pond –
(a) stocked with fish by the Commission for tuition of persons under the age of 16 years; and
(b) designated as such by a sign with the words "juvenile angling pond".
(2)  An expression in this order that is defined in the Act has the same meaning as so defined.
(3)  Any period specified in this order and identified by days and dates includes those days and dates.

4.   Taking of acclimatised fish

Acclimatised fish may only be taken during the following periods at the following places:
(a) between the Saturday nearest 1 August in any year and the Sunday nearest 31 May in the next year –
(i) Great Lake, other than Canal Bay; and
(ii) Lake Mackintosh; and
(iii) Lake Rosebery; and
(iv) Lake Burbury;
(b) between the Saturday nearest 1 October in any year and the Sunday nearest 31 May in the next year –
(i) Dee Lagoon; and
(ii) Lake Rowallan; and
(iii) Lagoon of Islands; and
(iv) Lake Skinner;
(c) between the Saturday nearest 1 November in any year and the Sunday nearest 31 March in the next year –
(i) Canal Bay in Great Lake; and
(ii) that portion of the canal conveying water from Bronte Lagoon to Bradys Lake, between the control gates in that canal on the Bronte-Tarraleah road and where the water enters Bradys Lake;
(iii) that portion of the canal conveying water from Pine Tier Dam to Bronte Lagoon, between the Marlborough Highway and for a distance of approximately 100 metres below the bridge on the Lyell Highway and marked by 2 white posts on opposite points of the canal; and
(iv) that portion of the canal conveying water from Dee Lagoon to Bradys Lake, between the mouth of the tunnel and Bradys Lake defined by 2 white posts on opposite points of the canal;
(d) between the Saturday nearest 1 November in any year and the Sunday nearest 30 April in the next year, in that portion of the Mersey River above Lake Rowallan, above 2 white posts on opposite shores of the river;
(e) between the Saturday nearest 1 November in any year and the Sunday nearest 31 March in the next year, in that portion of the Derwent River between the road bridge on the Lyell Highway at Derwent Bridge and the Hydro-Electric Corporation's radial gate at Lake St Clair;
(f) between the Saturday nearest 1 August in any year and the Sunday nearest 30 April in the next year, if no other period is specified –
(i) in excepted waters; and
(ii) in any inland waters that are not specified in clause 8 .

5.   Taking indigenous fish

The following indigenous fish may only be taken during the following periods at the following places:
(a) blackfish, in any inland waters that are not specified in clause 8 between the Saturday nearest 1 August in any year and the Sunday nearest 30 April in the next year;
(b) male freshwater crayfish, in any inland waters that are not specified in clause 8 , other than those specified in regulations 15 of the Inland Fisheries Regulations 1996 , between the Saturday nearest 1 August in any year and the Sunday nearest 30 April in the next year;
(c) whitebait, at the places and dates specified in a whitebait licence;
(d) any other indigenous fish, at any time in the waters specified in Schedule 1 of the Inland Fisheries Regulations 1996 .

6.   Taking fish in juvenile ponds

The taking of any fish in a juvenile angling pond is permitted only by a person under the age of 16 years.

7.   Taking fish in certain waters

The taking of any fish in the following waters is permitted only by an eligible person:
(a) Risdon Brook Reservoir;
(b) Coffee Creek.

8.   Prohibition on taking fish

The taking of any fish in any of the following waters is prohibited at all times:
(a) waters flowing into Arthurs Lake;
(b) waters of Brushy Rivulet flowing into Brushy Lagoon;
(c) waters flowing into Dee Lagoon;
(d) waters of Falls River between Russell Falls and the Tyenna River;
(e) waters flowing into Great Lake, including the Liawenee Canal;
(f) waters flowing into Lake Crescent, including the canal flowing from Lake Sorell;
(g) waters flowing into Lake Gordon, except Holley River, Pokana River, Boyes River, Gordon River or Adams River;
(h) waters flowing into Lake Kara;
(i) waters flowing into Lake Leake;
(j) waters flowing into Lake Pedder, including the Huon River above Lake Pedder and its tributaries;
(k) waters flowing into Lake Rowallan, except the Mersey River;
(l) waters flowing into Lake Sorell;
(m) waters in McPartlan Canal between Lake Pedder and Lake Gordon;
(n) waters flowing into Lagoon of Islands;
(o) waters in that part of Sisters Creek between a white post approximately 100 metres below the bridge in Birdland Nature park and a second white post approximately 100 metres above that bridge;
(p) waters in that part of St Mary's Rivulet between a white post approximately 180 metres below the main road bridge at St Marys and a second white post approximately 180 metres above that bridge;
(pa) [Clause 8 Amended by S.R. 1996, No. 115, Applied:21 Aug 1996] waters within the Warrawee Forest Reserve, except the waters in the main channel of the Mersey River;
(q) waters in which fish are maintained by the Commission or by any other person or body with the consent of the Commission for the purposes of fish culture or public display;
(r) waters within 100 metres of a fish trap maintained by the Commission;
(s) waters in that part of the No. 1 Canal and No. 2 Canal, conveying water from Shannon Lagoon to Penstock Lagoon above 2 white posts on opposite banks of those canals;
(t) waters within a radius of 50 metres where Agnews Creek and the canal flowing from Lake Sorell flow into Lake Crescent;
(u) waters within a radius of 50 metres where Dogs Head Creek, Silver Plains Creek and Mountain Creek flow into Lake Sorell;
(v) waters within a radius of 50 metres of the waters specified in paragraphs (a) , (b) , (c) , (e) , (g) , (h) , (i) , (j) , (k) and (n) .
