Repeal of Regulations Postponement Act 2021

An Act to postpone the repeal of the Fair Trading (Code of Practice for Retail Tenancies) Regulations 1998

[Royal Assent 16 December 2021]

Be it enacted by Her Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

1.   Short title

This Act may be cited as the Repeal of Regulations Postponement Act 2021 .

2.   Commencement

This Act commences on the day on which this Act receives the Royal Assent.

3.   Postponement of repeal

(1)  In this section –
Code of Practice Regulations means the Fair Trading (Code of Practice for Retail Tenancies) Regulations 1998 that –
(a) were made under the Fair Trading Act 1990 ; and
(b) were taken to be regulations, made and notified in the Gazette on 1 January 2011, in accordance with section 49 of the Australian Consumer Law (Tasmania) Act 2010 ; and
(c) were continued in accordance with section 25 of the COVID-19 Disease Emergency (Miscellaneous Provisions) Act 2020 .
(2)  The repeal of the Code of Practice Regulations that, but for this section, would have, in accordance with section 25 of the COVID-19 Disease Emergency (Miscellaneous Provisions) Act 2020 , been effected on 1 January 2022 is postponed until 1 January 2023.
(3)  Subsection (2) does not prevent the Code of Practice Regulations from being rescinded before 1 January 2023.

4.   Administration of Act

Until provision is made in relation to this Act by order under section 4 of the Administrative Arrangements Act 1990  –
(a) the administration of this Act is assigned to the Minister for Workplace Safety and Consumer Affairs; and
(b) the department responsible to that Minister in relation to the administration of this Act is the Department of Justice.

5.   Expiry

This Act expires on 2 January 2023.
